Liability Waiver and Release of Claims
1. Acknowledgment of Risk:
By purchasing tickets, I acknowledge that I am voluntarily participating in Easter Eggfest at the Farm (Jensen Farms) and I am aware that such activities involve certain risks, including, but not limited to, physical injury, property damage, or even death. I further acknowledge that these risks are inherent in the activity and that such risks may arise from the actions or negligence of others, or from environmental or physical conditions.
2. Assumption of Risk:
By signing this waiver, I freely and voluntarily assume all risks associated with my participation and that of any minors in my care, in Eggfest at the Farm, whether or not such risks are specifically listed or anticipated, including any injuries or damages that may occur as a result of my participation.
3. Release of Liability:
In consideration for being permitted to participate in Eggfest at the Farm, I, on behalf of myself, my heirs, assigns, and personal representatives, hereby release, waive, and discharge Jensen Farms, its officers, employees, agents, volunteers, and affiliates (the "Released Parties") from any and all liability, claims, demands, or causes of action that I may have for personal injury, property damage, or death resulting from my participation in this activity, whether caused by the negligence of the Released Parties or otherwise.
4. Indemnification:
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, actions, or causes of action, including legal fees and costs, arising out of or related to my participation in Eggfest at the Farm.
5. Health and Fitness:
I affirm that I am in good physical condition and do not suffer from any medical condition that would impair my ability to participate in the activity. I will inform Jensen Farms of any relevant medical conditions prior to participation.
6. Consent to Medical Treatment:
In the event of an injury or medical emergency during my participation, I authorize the Jensen Farms or its representatives to seek medical treatment on my behalf, and I agree to be responsible for any medical costs that may arise.
7. Governing Law:
This waiver shall be governed by and construed in accordance with the laws of Washington State. Any disputes arising from this waiver shall be resolved in the courts of Kittitas County.
8. Entire Agreement:
I understand that this document is intended to be as broad and inclusive as permitted by law, and that if any part of it is determined to be invalid or unenforceable, the remainder of the agreement will remain in full force and effect.
9. Acknowledgment and Signature:
I have read and fully understand the terms of this waiver. I am aware that by purchasing these tickets, I am waiving certain legal rights, including the right to sue. I voluntarily and knowingly agree to the terms and conditions set forth above.
